Terms of Service

These Terms of Service ("Terms") govern your use of ClawStore at clawstore.to ("Platform"). By creating an account or using ClawStore, you agree to these Terms. Please read them carefully.

1. The Service

ClawStore is a marketplace where independent sellers ("Sellers") list pre-built AI agent workspace bundles and buyers ("Buyers") purchase and download them. ClawStore acts as the marketplace operator — we are not a party to the underlying sale of a bundle, but we facilitate the transaction and establish the rules governing it.

2. Eligibility

You must be at least 18 years old to use ClawStore. By using the Platform you represent that you meet this requirement.

If you are using ClawStore on behalf of a business or organisation, you represent that you are authorised to bind that entity to these Terms.

3. Accounts

  • You are responsible for maintaining the confidentiality of your account credentials.
  • You are responsible for all activity that occurs under your account.
  • You may not create accounts for others without their consent, or create accounts to circumvent bans or restrictions.
  • We reserve the right to suspend or terminate accounts that violate these Terms.

4. Seller Terms

4.1 Listing Requirements

  • All bundles must be your own original work or work you are licensed to sell.
  • Bundle descriptions must be accurate and not misleading.
  • Each bundle must include the required components (SOUL.md, HEARTBEAT.md, and functional agent configuration files) to pass automated scanning and manual review.
  • Bundles may not include malware, spyware, backdoors, crypto-miners, or any code designed to harm or surveil users without their knowledge.
  • Bundles may not include or facilitate illegal activities, infringement of third-party intellectual property, or content that violates applicable law.

4.2 Approval Process

All submitted bundles undergo automated security scanning followed by manual review by ClawStore staff. We reserve the right to approve, reject, or remove any listing at our discretion.

4.3 Platform Fees & Payouts

ClawStore charges a platform service fee on each completed sale. The applicable fee rate is set by ClawStore and may vary by bundle type. The current fee schedule is available in your Seller dashboard settings.

Payouts are processed via Stripe Connect. You must complete Stripe's identity verification and connect a valid bank account to receive payouts. Payout timing is subject to Stripe's standard processing schedules. ClawStore is not responsible for delays caused by Stripe or your bank.

For maintenance plans and add-on bundles, funds may be held in escrow until delivery is confirmed. The escrow period is determined by the delivery timeline you set when creating the listing.

4.4 Seller Warranties

By listing a bundle you warrant that: (a) you have the right to sell it, (b) the content does not infringe any third-party intellectual property rights, and (c) the bundle performs as described.

5. Buyer Terms

5.1 Purchases

All purchases are final. By completing a purchase you agree that the digital nature of the product makes it immediately consumable, and you waive any right to a cooling-off period where permitted by applicable law.

5.2 Refund Policy

Due to the digital nature of bundles, we generally do not issue refunds after download. Exceptions may be made where: (a) the bundle is materially different from its description, (b) the bundle contains malware or code that damages your systems, or (c) the Seller fails to deliver on a maintenance or add-on order within the stated timeframe.

Refund requests must be submitted via support@clawstore.to within 7 days of purchase.

5.3 Licence to Use

Purchasing a bundle grants you a personal, non-exclusive, non-transferable licence to deploy the bundle for your own use (including commercial use within your own organisation). You may not resell, sublicence, or redistribute bundle contents without explicit written permission from the Seller.

6. Prohibited Conduct

You may not use ClawStore to:

  • Violate any applicable law or regulation
  • Infringe the intellectual property rights of any party
  • Upload or distribute malware, ransomware, spyware, or any harmful code
  • Harass, threaten, or harm other users
  • Attempt to gain unauthorised access to ClawStore systems or other users' accounts
  • Use automated tools to scrape, crawl, or mass-download content without permission
  • Circumvent security scanning or use obfuscation to hide malicious functionality
  • Create fake reviews or manipulate the rating system
  • Process transactions outside of the ClawStore platform to avoid fees ("fee circumvention")

7. Intellectual Property

Sellers retain ownership of their bundle content. By listing on ClawStore, Sellers grant us a non-exclusive, worldwide licence to host, display, and deliver the bundle for the purpose of operating the marketplace.

The ClawStore platform, design, logo, and branding are the property of ClawStore. You may not copy or use them without written permission.

8. DMCA & Copyright

We respect intellectual property rights. If you believe a bundle infringes your copyright, send a DMCA takedown notice to dmca@clawstore.to with:

  • Identification of the copyrighted work
  • Identification of the infringing material (URL or bundle ID)
  • Your contact information
  • A good-faith statement that the use is not authorised
  • A statement of accuracy and authority, under penalty of perjury

We will process valid notices within a reasonable time and may suspend the listing pending investigation.

9. Disclaimers

ClawStore provides the marketplace "as is" without warranties of any kind, express or implied, including fitness for a particular purpose, merchantability, or uninterrupted availability.

We do not guarantee the accuracy, completeness, or quality of any bundle listed by Sellers. Buyers should evaluate bundles before deploying them in production environments.

10. Limitation of Liability

To the maximum extent permitted by law, ClawStore and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform, including but not limited to loss of profits, data, or business opportunities. Our total liability to you for any claim arising from these Terms shall not exceed the greater of (a) the amount you paid ClawStore in the 12 months preceding the claim, or (b) $100 USD.

11. Indemnification

You agree to indemnify, defend, and hold harmless ClawStore, its officers, directors, employees, and agents from any claims, damages, or expenses (including reasonable legal fees) arising from your use of the Platform, your bundles, or your violation of these Terms.

12. Governing Law & Disputes

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law principles. Any dispute arising from these Terms shall be resolved through binding arbitration under the rules of the American Arbitration Association, except that either party may seek injunctive relief in a court of competent jurisdiction. You waive the right to participate in class-action proceedings.

13. Modifications

We may modify these Terms at any time. Material changes will be announced via platform notification. Continued use of ClawStore after changes take effect constitutes acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Platform.

14. Termination

We may suspend or terminate your account at any time for violation of these Terms or for any other reason with or without notice. Upon termination, your right to use the Platform ceases immediately. Provisions that by their nature survive termination (including payment obligations, intellectual property rights, disclaimers, and limitation of liability) will survive.
